PROPHON represents the neighbouring rights of producers of phonograms and music video recordings, as well as the rights of performing artists in Bulgaria. You do not need to be our member to get your royalties. We at PROPHON pay out due amounts to all performing artists and producers for whom allocation is made.
You can become our member by filling in the relevant documents (sample application form where you specify the capacity in which you would like to become a member; Membership Agreement signed by you with which we set the territory and the scope of rights you delegate to us to manage on your behalf) and submitting them to the Distribution Department by email razpredelenie@prophon.org or phone: 02/ 981 45 41; 02/ 963 27 57
Upon receipt, your application will be reviewed by the Managing Board at one of its three annual sessions in January, May and September. When your application gets officially approved, we will prepare an individual membership agreement for you.
In order to fully sort out your rights for legal use of the music you like, you have to sign agreements with both organisations. Musicautor represents authors of music and lyrics, while we at PROPHON represent performing artists and producers of audio recordings. Those rights differ, hence the existence of two separate organisations. In order to have fully licenced music at your business, you must have contracts with both societies.
Use of music works at hotels, bars, restaurants, shops, fitness clubs, and other business establishments constitutes public performance for which remuneration is due to performing artists and producers.
The fee you pay to the cable operator is only for the service provided to you – namely the television signal provided. This does not settle the public performance rights that require separate arrangements. Additionally, each TV channel, including sports and cooking programmes, uses audio and video musical recordings that are also subject to neighbouring rights, such as theme music and caches of their TV shows. In this sense each use of your TV set on the business premises operated by you constitutes public performance of sound recordings, hence neighbouring rights apply, and you need to pay for this use accordingly.
Yes, you do need a licence from PROPHON. Under the Copyright and Neighbouring Rights Act all types of use of a given work are subject to fees in favour of the rightholder or a collecting society, PROPHON being the only such society for Bulgaria.
The price for each establishment depends on its type and category. To check how much the licence fee would be for you, use the calculator available on our website. There you can calculate the annual amount you should pay to PROPHON. The fees payable to PROPHON are not high at all. The amounts, depending on the type of establishment, start from less than BGN 0,01 per seat per day.
If your business involves premises clients have access to and where music audio and video recordings are used as background, you should have proper arrangements for authorised use of this type. We at PROPHON protect the rights of the performing artists and phonogram producers who have released the recordings of the works you are using.
The funds you pay to us get distributed to the performing artists that took part in the audio recordings and to the phonogram producers; this would be their remuneration for their intellectual work.
Under the Copyright and Neighbouring Rights Act, media are required to provide reports to our organisation on the music they broadcast. Should those statements be incomplete, media monitoring allows to fill in missing items and to make adjustments if needed, which provides extra guarantee for transparency in the allocation of collected royalties.
Yes. An important requirement is that the audio recording used in the advertisement be registered in the BMAT database prior to launching.

You should keep in mind that MyProphon and BMAT are two entirely different systems and separate databases containing different information. You are entitled to remuneration if your recordings are used abroad. The following is required for this purpose:
Remunerations are paid once a year, after the finalisation of the distribution.
To receive your royalties, you should contact our Distribution Department on email: razpredelenie@prophon.org
If you are both a performing artist and producer, you have to/should select one capacity. As anatural person or as a legal entity you can be a member in a single category. Of course you can register your recordings in both capacities.
We do not administer neighbouring rights of performing artists and producers of phonograms and music video recordings on the internet. Those rights are governed by a licence between the performing artist/producer and the relevant online platform instead.

The purchase of a CD settles just your right for personal use. Once you start using the CD in a business environment as background music, for example in shops, restaurants, service centres– this becomes public performance. To get the rights for public performance of the music you like in your business premises, you have to get the relevant authorisation.
The quickest and easiest way to apply for licence is via the calculator on our website. You should only fill in the blanks with the details required and send it. Once we get the application, we will send you back the ready documentation.

The right to access to radio signals refers solely to personal use. Each use of a recording without prior authorisation for this is infringement of the Copyright and Neighbouring Rights Act. In this sense whenever radio is used on the business premises you operate, this represents public performance of recordings, hence neighbouring rights apply and you need to pay for this use accordingly.
We all know that before a live appearance, a band needs warming up of the atmosphere. It is common practice to use audio recordings before and after the live performance, as well as in between sets. Thus you have to take care of the neighbouring rights for this use of recordings. Also, oftentimes the performing artist uses recorded accompaniment (instrumentals) to support his/her live vocal part. As not all rightholders perform their parts live and as music recordings are used between sets, the obligation to have a licence stays for you.
